Terms and conditions

1. Scope of Applicability

The general terms and conditions (henceforth referred to as “T&C”) for the PSI Visitor Center of the Paul Scherrer Institute apply to all products, services and orders (henceforth „products“) concluded via the online shop of PSI Visitor Center at www.psi.ch/en/shop (henceforth «PSI Shop»). Orders can be placed at any time in the psi shop. The offer is available to everyone. Any natural or juridical person that maintains business relations with the psi shop is henceforth referred to as «customer». The following T&C apply exclusively in the version effective at the time of your order. Deviating terms and conditions of the customer are not recognised by the psi shop unless the psi shop had explicitly agreed to their validity in writing.

2. Services and Information

The product information for the products displayed in the psi shop is compiled by the PSI Visitor Center as clearly as possible. As long as this is a matter of information provided by the manufacturer, the manufacturer’s information is decisive. The psi shop strives to depict the manufacturer’s information correctly but cannot grant warranty for it.

3. Offer

The offer is valid as long as it appears in the psi shop and/or while stocks last. Prices and product ranges are subject to change at any time. The images shown in the psi shop as well as all information on the products are for illustration purposes and are non-binding.

4. Conclusion of Contract

The customer’s order represents an offer to the PSI Visitor Center to conclude a contract of sale. A contract of sale will be concluded only when the PSI Visitor Center sends the ordered product to the customer or when the customer picks it up at the PSI Visitor Center. Products from the same order that are not listed in the shipping confirmation will not be included in the contract of sale. Contracting party is the Paul Scherrer Institute, PSI Visitor Center in 5232 Villigen PSI. Not all products listed in the online shop are also in stock on site at the PSI Visitor Center.

The PSI Visitor Center reserves the right to refuse orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded, in particular no forwarding of non-deliverable products will take place. Temporarily unavailable products cannot be reserved.

5. Payment

The price indications include the value added tax and are stated in Swiss Francs. On site at the PSI Visitor Center, payments can be made with debit and credit cards, Postcard or TWINT.

In the psi shop, the customer undertakes to pay for the order with one of the provided payment options. Upon collection, payment in cash is not possible. The psi shop reserves the right to exclude customers from certain types of payment without the indication of any reasons. As long as a credit card purchase is concerned, the respective amount will be debited from the credit card account and the product will be shipped.

6. Shipment

The ordered products – if in stock – will immediately be forwarded to dispatch in 1 to 3 business days or be made available for collection. Otherwise, a written order confirmation with the expected delivery date will be sent per e-mail. For deliveries within Switzerland and the Principality of Liechtenstein the recipient pays a shipping fee of CHF 10.–. At an order volume of CHF 300.– and higher, the shipping fee within Switzerland is included. For deliveries abroad, arising additional costs will be charged. Additional customs fees may be due in the country of destination. Those have to be paid by the customer.

7. Delivery

Unless otherwise agreed upon, the delivery is carried out from the storage location to the delivery address provided by the customer. The ordered products can only be sent to one address. If a partial delivery is necessary for an order, the shipping fee will be invoiced only once. The delivery of the product, including the case of a partial delivery, will be made at the expenses and risks of the customer. All indications regarding availability, shipment or delivery are merely estimated indications and approximate guiding values. Should the psi shop notice that, during the processing of the order, your ordered products are not available, you will be informed separately via e-mail or telephone.

8. Reservation of Ownership

The delivered products remain property of the PSI Visitor Center until full payment.

9. Right of Cancellation, Exchange and Return

The possibility of cancellation depends on the product and is only possible before shipment.

The possibility of cancelling orders depends on the product. Exchange and returns can only be taken into account within 14 days of receipt of the products. Products reduced in price are excluded from exchange. The cancellation must be made in writing or by return of the unused products. Furthermore, an exchange or return is only possible if the product shows no signs of use. The return is made at the customer’s expense. In the case of a return, a copy of the order documents must be enclosed or in case of a return on site the original invoice must be provided. Postal and shipping fees will not be reimbursed. The resulting amount to your credit may be lowered due to additional expenses and costs for the psi shop and can be reimbursed in the form of a voucher.

10. Notice of defects

If products are delivered with obvious damage to the packaging or the contents, the customer must complain about this immediately to the delivery carrier and refuse acceptance, without prejudice to his rights in respect of defects. The customer is obliged to obtain a damage confirmation report from the delivery carrier. In addition, all transport damages have to be reported to the PSI Visitor Center immediately. Furthermore, it is the customer's responsibility to inspect the ordered products immediately upon receipt. Any defects or deviations from the order must be reported by the customer to the PSI Visitor Center immediately. The PSI Visitor Center reserves the right to demand proof of the defect.

 

11. Passing of risk and Liability

The risk shall pass to the customer as soon as the consignment has been handed over to the person carrying out the transport.

The PSI Visitor Center shall only be liable to the customer for direct proven damages caused by the PSI Visitor Center intentionally or by gross negligence or as far as an exclusion of liability would contradict applicable law. In no case shall PSI Visitor Center be liable for slight negligence, indirect and consequential damages as well as consequential damages such as loss of profit.

12. Protection of Privacy

When collecting, processing, and using personal data, the terms of the Swiss Data Protection Law and the relevant legal regulations fully apply. The customer data received throughout the ordering process will generally not be passed on to third parties. Only bodies entrusted with the execution of the order (e.g. the post office) will have access to the data absolutely necessary for them. The customer agrees to this usage of their data. In all other respects, the customer has the right to see the data stored about them.

13. Applicable Law and Place of Jurisdiction

For this contractual relationship s exclusively Swiss law applies, with the exclusion of conflict of law provisions and excluding the provisions of the Vienna Sales Convention (United Nations Convention on Contracts for the International Sale of Goods, concluded in Vienna on 11 April 1980).

The exclusive place of jurisdiction for all legal disputes arising from or in connection with this contractual relationship shall be Aarau, Switzerland. Notwithstanding the foregoing, the PSI Visitor Center shall be entitled to seek interim measures from any other competent court.
